I got the ML after much grunting squealing and contorting with the medium behind a curtain in a 25deg tiny shop, I had consumed perhaps close on double figures pints of frawleys stout the night before and had slept in my clothes and in my jeep blink.gif tongue.gif

Those of you who are wise in the ways of consumer rights; if you take something back that clearly has a defect you're within rights to ask for a full refund - correct? If they say it's up to the manufacturer to decide whether it's worth fixing or fixable can be disputed because of that right - correct?

Went for the West, and tried it out today. Well impressed, its very warm and flexible. Good tight cuffs too, the sleeves stay put while paddling and after a few wipeouts, niggly problem on my old suit. Will see how it holds up after a few more weeks.

Well wear mate, it is very flexible - 100% Ultraspan (whatever that is) rocks!! Let me know how the suit fairs for ya, my suit flushes but Ive a suspicion its due to weight loss! blink.gif

It depends on the manufacturer lads, with electronic items if you return the item to the shop you purchased it in within 14 days in its original condition and boxed you can get a refund or a replacement, after the 14 days the manufactures warranty takes care of any problems and the item has to go away for repair and if deemed not repairable a replcement will be given (but repair or replacement will only happen if the product isnt deemed physically damaged by the customer), I have seen retailers taken to the small claims courts over mobile phones over the last few years and it only causes stress and headaches for both parties, make sure to read the small print and warranty section of anything you buy when returning it as its all there ph34r.gif

don't know about you guys but i am still in my 3/2 without booties and had a good 2 x 2hr sessions last sunday without feeling any bite. its funny because half the lineup were out there in full winter steamers with hoods up and even gloves - and i feel the cold normally. longboardirl/cold.gif

I dont know whether it will work or not, they would be more likely to give you another suit rather than a refund.

Consumer rights do exist but so do the retailers, everything in that statement is correct but it should read :

You can get a refund IF you purchased the product less than 14 days ago, still have everything that was supplied with it and it isnt physicaly damaged

You can get a replacement IF you purchased the product less than 14 days ago, still have everything that was supplied with it and it isnt physicaly damaged or it is deemed unrepairable by the manufacturer due to a fault not caused by the customer

or

You purchased the product and your 14 day turn around as a consumer has passed, the product will be sent for repair by the manufaturer and will be repaired if repairable and replaced if not unless it has been deemed physicaly damaged by the consumer

Comments on consumer rights websites like "You can insist on a refund, a replacement or a repair" just cause confusion to customers and you have customers going back to retailers complaining, demanding refunds/replacements and thinking they are entitled to them when in fact, by law, they are not, the key word in that statement is "or" it is not "you" the consumers choice

Normally, if you mention the words "1988 sale of goods and services act" the whole picture will change fairly dramatically in your favour !

The waters are muddying again so because that website makes no mention of the 14 day return window.

The suit is physically damaged, but no retailer or manufacturer could claim after 4 weekends of surf that their suit could be prone to leaks - it'd be the equivalent of new tyres having bald patches after the 20 hours of driving in normal conditions.

Repair is out of the question given the suits age and the turnaround time involved so if it's suggested I'll just refuse. Refund or replacement will come down to what's available.

Failing that it's '1988 Sale of Good & Services Act' wink.gif

Didn't have time to return it today so tomorrow it is.

Thats the problem with the site it doesnt tell you your exact rights, the 14 day return might be different for other products aswell, it is 14 days with electronic items, it could be more with clothing, sports equipment, wetsuits etc.
